These terms and conditions set out the terms on which any person (“you”; “your”) may access, make use of and make payments to forever manchester/Community Foundation for Greater Manchester (“we”; “forever manchester”, “Community Foundation for Greater Manchester”) on that part of the forever manchester website identified as being the “forever manchester island”. 

By registering, accessing or using the forever manchester website or making any payment, you acknowledge that you have read, understood and agree to be bound by these terms and conditions. If you do not agree to be bound by these terms, you should not use this Website.

The materials provided on this Website are protected by English Law.

The website www.forevermanchester.com (our “Website”) is operated by us, Community Foundation for Greater Manchester, a registered charity under charity number 1017504. Our address is 5th Floor, Speakers House, 39 Deangate Manchester M3 2BA.

Payments to Forever Manchester

The provisions of this clause provide the terms on which you make any payment via the Website. Payments made via this Website shall be donations made by you to Forever Manchester.

We shall not be under any obligation to refund any payment to you. Gift Aid: Payments made by individuals are eligible for Gift Aid. However, payments not being donations (in particular, payments made in respect of advertising) may not be eligible for Gift Aid. 

Posting messages

Please use the Website responsibly. You are solely responsible for any content which you submit to the Website. You agree to use this Website only for lawful purposes. By using our Website you agree not to attempt to access our systems and you agree not to: 

  • (a) post on or transmit to or from it any material that is threatening, offensive, violent, pornographic, obscene, hateful, discriminatory or that could encourage the commission of a criminal offence;
  • (b) submit any material that is defamatory or libellous;
  • (c) submit any content which contains swear words or other objectionable language;
  • (d) submit material which infringes the intellectual property rights of a third party, including any privacy rights;
  • (e) post inaccurate or false information about yourself or others or content which appears to impersonate someone else; or
  • (f) submit any other material which is considered to be inappropriate, (a) to (f) inclusive are together referred to as “Inappropriate Content”.

We will fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity of or to locate anyone posting any Inappropriate Content or other similar material onto our Website.

Please note that any message that is posted on the Website may be seen, collected and used by any other person. If you post any email or website details on the Website you may receive unsolicited messages from other persons.

Any advertisements on this site must conform to the British Code of Advertising Practice (“BCAP”) and must accurately reflect the product and/or service being advertised. Advertisements considered as not being in line with BCAP or our advertising policies will be removed. 

This is at the sole discretion of forever manchester. All claims made in advertisements must be capable of being supported by appropriate evidence and must be made available upon request.

We reserve the right to omit, suspend, or change the position of any advertising, even if it has already been accepted. The inclusion of an advertisement on the Website does not constitute endorsement of the advertiser, its products or services.

We will not be liable for any loss or damage caused by the content of or any errors in any advertisements on the Website.

Length of time the website will be live 

Subject to the other provisions of these terms and conditions we intend to operate the Website until at least December 2013 or later. Notwithstanding this intention, we may discontinue operation of the Website or any part of it at any time.

Fundraising

Forever Manchester does not authorise you to act as an agent for or on behalf of Forever Manchester, so neither you nor your fundraising materials may suggest that you represent forever manchester events or activities.If you are a business and you are fundraising by selling goods or services, or by running a promotion, the law requires you to have a Fundraising Agreement with us. 

You may also need a Fundraising Agreement if you are a member of the public and you are deducting any costs, expenses or other amounts from your fundraising. If you wish to discuss entering into a Fundraising Agreement with us, please contact us at the contact details set out below.

Forever Manchester is not responsible for organising, supervising or hosting your fundraising activity and all activities and participation in them are at the organisers’ and participants’ own risk. 

We do not accept responsibility or liability for any loss or damage, or for any death or personal injury, arising out of any fundraising activity, including liability as a result of negligence.You should always consider whether you need appropriate insurance cover for your fundraising activity. If necessary, carry out a risk assessment and make sure participants are fully briefed about the activity.

Registration and passwords

If you register with us and are asked to provide a password, you agree:

  • To keep your password secure and confidential and not allow anyone else to use your email address or password to access this Website 
  • Not to do anything which would assist anyone who is not a registered user to gain access to any registration area of this Website
